Terms of Service

Last updated: 25 August 2026

1. Overview

This website is operated by Ruby’s Sweet Shop. Throughout the website, the terms “we”, “us” and “our” refer to Ruby’s Sweet Shop.

Ruby’s Sweet Shop is operated by Shannon Robertson as a sole trader and is based in Perth, Scotland.

Business address: Vision House Business Centre, Shore Road, PH2 8BD
Email: hello@rubyssweetshop.co.uk

By visiting our website or purchasing from us, you agree to these Terms of Service. These Terms apply to all website visitors and customers.

Please read these Terms carefully before using our website or placing an order.

2. Our products

We sell pick-and-mix sweets, prepared sweet mixes, chocolates, gifts and seasonal products.

We make every reasonable effort to display product descriptions, colours, weights and images accurately. However, product colours and appearances may vary slightly from the photographs shown because of manufacturing variations and different screen displays.

Product availability is subject to change. We may withdraw, replace or update products without notice. We will not substitute an unavailable item in an order without contacting you where the change would materially affect the product or its allergen information.

3. Ingredients and allergens

Customers must review the ingredients and allergen information provided before placing an order.

Our products are stored, handled and packed in an environment where various allergens are present. Although we follow allergen-management and cleaning procedures, we cannot guarantee that products will be completely free from traces of allergens due to the possibility of cross-contact.

If you have a food allergy, intolerance or dietary requirement, please contact us before ordering at hello@rubyssweetshop.co.uk.

Do not rely solely on checkout notes to inform us about an allergy. Please read our separate Allergen Information page for further details.

4. Placing an order

By placing an order, you confirm that:

  • The information you have provided is complete and accurate

  • You are authorised to use the selected payment method

  • You have checked the product, ingredient and allergen information

  • You agree to these Terms of Service

Submitting an order does not guarantee that it has been accepted. A contract is formed when we send confirmation that your order has been accepted or dispatched.

We reserve the right to refuse or cancel an order where:

  • A product is unavailable

  • Incorrect pricing or product information has been displayed

  • Payment has not been authorised

  • We suspect fraud, misuse or unauthorised activity

  • We cannot safely fulfil the order

  • The delivery address is incomplete or outside our delivery area

If we cancel an order after payment has been taken, we will issue a refund to the original payment method.

5. Prices and payment

All prices are displayed in pounds sterling.

Delivery charges are shown separately during checkout before payment is completed.

We may change our prices at any time. Price changes will not affect orders that we have already accepted, except where there has been an obvious pricing error.

Payment must be received and authorised before an order is prepared or dispatched.

6. Discount codes and promotions

Discount codes and promotional offers:

  • Must be used within the stated promotional period

  • Cannot normally be exchanged for cash

  • Cannot be applied after an order has been placed

  • Cannot be combined unless we state otherwise

  • May be restricted to selected products or minimum order values

We may withdraw or amend a promotion where necessary, but this will not affect orders already accepted using the promotion.

7. Cancelling or changing an order

Please contact us as soon as possible if you need to cancel or change your order.

We will try to accommodate your request, but changes cannot be guaranteed once preparation has started, and an order cannot normally be changed or cancelled after dispatch.

Any statutory cancellation rights and applicable exceptions are explained in our Returns and Refunds Policy.

8. Delivery

Available delivery methods, prices and estimated timescales are displayed at checkout and explained on our Delivery Information page.

Delivery estimates begin from the dispatch date and are not guaranteed delivery dates unless expressly stated otherwise.

Customers must provide an accurate delivery address. If you notice an error, please contact us immediately. We cannot guarantee that an address can be changed after dispatch.

When we arrange delivery, the order remains our responsibility until it is delivered to you or to a person you have authorised to receive it.

If an order is delayed, missing or damaged during delivery, please contact us at hello@rubyssweetshop.co.uk.

9. Returns and refunds

Because we sell food, certain products cannot be returned after being opened or unsealed for food safety, health protection and hygiene reasons.

Other legal exceptions may apply to products that deteriorate or expire rapidly and to qualifying personalised products.

These restrictions do not affect your statutory rights if an item is faulty, damaged, unsafe, incorrectly supplied or not as described.

Please read our Returns and Refunds Policy for the full conditions and instructions.

10. Problems with an order

Please inspect your order as soon as it arrives.

If an item is damaged, faulty, missing, incorrect or not as described, contact us as soon as possible and preferably within 48 hours. Please include your order number, a description of the problem and clear photographs where applicable.

The request to contact us within 48 hours helps us investigate the problem and does not remove or reduce your statutory rights.

Please retain the product and all packaging until we have assessed the issue.

11. Acceptable website use

You must not:

  • Use this website for unlawful or fraudulent purposes

  • Attempt to interfere with the website’s security or operation

  • Introduce viruses, malicious software or harmful code

  • Collect or misuse another person’s information

  • Copy or commercially exploit our website content without permission

  • Place false, abusive or fraudulent orders

We may restrict or terminate access to the website where these Terms are breached.

12. Intellectual property

The Ruby’s Sweet Shop name, logo, branding, photographs, graphics, written content and website materials belong to us or are used with permission.

You may not reproduce, distribute, modify or use our content for commercial purposes without our prior written permission.

13. Third-party services and links

Our website may use or link to third-party services, including payment providers, delivery companies and external websites.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for the content or operation of third-party websites that we do not control.

Nothing in this section limits our responsibilities to you for services we select to fulfil your order.

14. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful. This includes liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Breach of your statutory consumer rights

  • Any other liability that cannot legally be excluded

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from products purchased for personal use.

15. Events outside our control

We will not be responsible for delays or failure to perform our obligations caused by events outside our reasonable control.

If such an event significantly affects your order, we will contact you as soon as reasonably possible and explain the available options. Your statutory rights remain unaffected.

16. Privacy

We process personal information in accordance with our Privacy Policy.

By placing an order, you confirm that the information you provide is accurate and that we may use it as reasonably necessary to process payment, prepare your order, arrange delivery and provide customer support.

17. Changes to these Terms

We may update these Terms occasionally to reflect changes to our business, website, services or legal obligations.

The version that applies to an order is the version published when the order is placed. The latest update date will appear at the top of this page.

18. Governing law

These Terms are governed by Scottish law.

If you live elsewhere in the United Kingdom, you will continue to benefit from any mandatory consumer protections that apply where you live and may be entitled to bring legal proceedings in your local courts.
